Skyfest website conditions

These Terms and Conditions shall apply to your use of the Skyfest online website located at www.skyfest.co.uk (the 'website').

By using the website, you agree to be bound by these Terms and Conditions and the Privacy Policy set out below. If you do not wish to be bound by these Terms and Conditions and the Privacy Policy, you should not use the website.

This contract is with British Sky Broadcasting Limited. Where we refer to 'we/us' in these terms it means British Sky Broadcasting Limited of Grant Way, Isleworth, Middlesex TW7 5QD and 'our' shall be interpreted accordingly. 'you' means you, the user of the website and 'your' shall be interpreted accordingly. 'Users' means the users of the website collectively and/or individually as the context admits.

Sky may change these Terms and Conditions and the Privacy Policy from time to time and so you should check these regularly on the website. Your use of the website will be deemed an acceptance of the terms existing at that time.

You must be employed by a Sky group company to use the website and register for tickets to Skyfest. The website is for the sole use of Sky employees, their friends and family.

  1. 1. ACCEPTABLE USE
    You agree that any use by you of the website shall be in accordance with the following conditions:
    1. 1.1. You will not post or transmit through the website any defamatory, threatening, obscene, harmful, pornographic or otherwise illegal material or material which would violate or infringe in any way upon our rights or those of others (including intellectual property rights, rights of confidentiality, or rights of privacy) or cause distress or inconvenience. You must not express opinions that are vulgar, crude, sexist, racist or otherwise offensive. Always treat other users with respect.
    2. 1.2. You will not post or otherwise make available on the website any material which you do not own without the express permission of the owner of the material. By posting material to the site you warrant that you have obtained all the necessary consents to do so and to make it available to us for the purposes set out in these Terms and Conditions (This includes, for example, getting the consent of any person identified in a photo. Where the photo identifies a child you must have the consent of their parent or legal guardian.)
    3. 1.3. You will not copy, download, reproduce, republish, frame, broadcast, transmit in any manner whatsoever, any material on the website.
    4. 1.4. You will abide by the specific rules of any competition or promotion that you participate in on or via the website.
    5. 1.5. You will not do anything that affects the operability or security of the website or causes unreasonable inconvenience or offence or disruption to our staff.
  2. 2. THIRD PARTY WEBSITES
    1. 2.1. You acknowledge and agree that we are not responsible for the availability of any third party websites or material you access through the website.
    2. 2.2. We do not endorse and shall not be held responsible or liable for any content, advertising, products or services on or available from such websites or material.
    3. 2.3. Any dealings between you and any third party advertisers or merchants found on or via the website, including payment for and delivery of products, services and any other terms, conditions, warranties or representations associated with such dealings, are made between you and the relevant advertiser or merchant. Therefore, we are not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings.
  3. 3. INTELLECTUAL PROPERTY
    1. 3.1. All copyright, trade marks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in us or our licensors. You are permitted to use this material or content only as expressly authorised in writing by us or our licensors. You will not, and you will not assist or facilitate, any third party to copy, reproduce, transmit, distribute, frame, commercially exploit or create derivative works of such material or content.
    2. 3.2. If you become aware of any such distribution or commercial exploitation, you agree to notify us immediately.
    3. 3.3. You acknowledge that by posting materials on the website, you grant to us and our licensors and assigns an irrevocable, perpetual, royalty free, worldwide licence to use the materials both within the website and in any other manner. The licence extends to copying, distributing, broadcasting, and otherwise transmitting, and adapting and editing the materials.
  4. 4. LIABILITY FOR AND INFORMATION PROVIDED ON THE WEBSITE
    1. 4.1. Material which is posted on any message or bulletin boards or chat forums is written by our event organisers and we do not necessarily endorse such material.
    2. 4.2. The maps contained in the website are for illustration only and are not to scale and do not necessarily reflect the actual layout/content of the events.
    3. 4.3. We will not be held responsible or liable for the content, accuracy, timing or reliability of any information or statements contained within the website, or for statements, advice and/or opinions made or given by the event organisers on the bulletin boards and chat forums (except as required by law). If you have any claim arising from the actions or statements of another user, you agree to pursue such a claim only against the event organiser and not from us.
    4. 4.4. We will endeavour to provide the website using all reasonable care. Except as required by law, we will not be responsible or liable for the quality, accuracy or fitness for a particular purpose of the website and do not promise that the material contained in the website, or any of the functions contained in the website or its server will operate without interruption or delay or will be error free, free of viruses or bugs, or is compatible with any other software or material.
    5. 4.5. We will be liable for any fraudulent misrepresentations we make and for any death or personal injury caused by our negligence. We will not be responsible or liable to you for any other loss or damage that you or any third party may suffer as a result of using or in connection with your use of the website.
  5. 5. REGISTRATION
    1. 5.1. You must register on Skyfest.co.uk in order to gain tickets for the event. You will be required to enter your name and employee number. We reserve the right to change the closing date for registration without notice.
    2. 5.2. You must take all precautions to prevent your details being used by anyone else to access the ticket registration.
    3. 5.3. You must only use your own personal information to register. You must not impersonate colleagues or use colleagues' personal information to create an account.
    4. 5.4. If we reasonably believe that your login details are being used in any way which is not permitted or acceptable to us, we may cancel your account immediately without giving you any notice and may refuse you entry to Skyfest
    5. 5.5. When registering on the website you must provide us with accurate, true and correct information about you and, where applicable, you must keep this information up-to-date. By registering on the website you warrant that you have provided information that is true, accurate and correct.
    6. 5.6. f we have reason to believe you are no longer employed by a Sky group company or are serving your notice then we may delete your account and cancel your tickets.
  6. 6. TERMINATION

    We may immediately terminate your use of the website (including your registration if applicable) if you breach, or we have reasonable grounds to believe that you are likely to breach these terms and conditions, or you otherwise engage in conduct which we determine in our sole discretion to be unacceptable. We may also take disciplinary action against you in line with your terms of employment.

  7. 7. GENERAL
    1. 7.1. Your registration is personal to you and you may not transfer either it or your rights or obligations under these terms to anyone else.
    2. 7.2. All or any part of any term of this agreement that is found to be unfair or unenforceable will be treated as deleted and the remainder of the terms will continue to govern each of our respective obligations going forward.
    3. 7.3. Your use of the website is governed by the law of the country in which you live. These terms and conditions are governed by the laws of England and Wales and any disputes can be dealt with by any UK court that can lawfully deal with the case. If your address is in the Republic of Ireland, any disputes can be dealt with by the courts in England and Wales or in the Republic of Ireland.
